Governing the use of our website and the provision of safari and travel-related services.

Welcome to Crane Adventure Safaris ("the Company," "we," "us," or "our"). These Terms and Conditions ("Terms") constitute a legally binding agreement between Crane Adventure Safaris, a duly registered tour operator in the Republic of Uganda, and any individual or entity ("the Client," "you," or "your") who accesses our website, makes a booking, or utilizes any of our safari experiences, tours, and travel-related services ("Services").

By accessing our website, making a booking, or availing yourself of our Services, you expressly acknowledge that you have read, understood, and irrevocably agree to be bound by these Terms in their entirety. If you do not agree with any provision herein, you must immediately cease use of our website and refrain from making any bookings.

1. Definitions and Interpretation

In these Terms, unless the context otherwise requires, the following expressions shall bear the meanings assigned to them:

  • "Booking" means any reservation, order, or request for Services made by the Client and accepted by the Company.
  • "Confirmation" means the written acknowledgment issued by the Company to the Client confirming acceptance of a Booking.
  • "Force Majeure Event" means any circumstance beyond the reasonable control of the Company, including but not limited to acts of God, war, civil unrest, terrorism, natural disasters, epidemics, pandemics, government restrictions, strikes, or any other event that renders the performance of Services impossible, illegal, or impracticable.
  • "Permit" means any license, authorization, or permit required for access to national parks, wildlife reserves, gorilla trekking, chimpanzee tracking, or any other regulated activity.

2. Booking and Confirmation

A Booking shall only be deemed valid and binding upon the Company once the Client has paid the required deposit or full payment as stipulated at the time of booking and the Company has issued a written Confirmation to the Client. The Company reserves the unconditional right to decline any Booking at its sole discretion without providing reasons.

All Bookings are subject to availability of accommodations, Permits, transportation, and other logistical arrangements. The Company does not guarantee the availability of any particular lodge, guide, vehicle, or service until a Confirmation has been issued.

3. Payments and Financial Terms

3.1 Accepted Payment Methods

The Company accepts payments through methods communicated at the time of booking, which may include but are not limited to bank transfers, credit and debit cards, mobile money platforms, and cash payments. The Client bears full responsibility for any transaction fees, currency conversion charges, or intermediary bank charges associated with their payment method.

3.2 Deposit and Balance

A non-refundable deposit of no less than thirty percent (30%) of the total booking value is required to secure any Booking unless otherwise agreed in writing. The remaining balance shall be paid no later than forty-five (45) days prior to the scheduled commencement of Services. Failure to remit the balance by the due date shall entitle the Company to treat the Booking as cancelled by the Client without further notice.

4. Cancellation and Refund Policy

All cancellation requests must be submitted in writing and shall become effective only upon written acknowledgment by the Company. The following cancellation charges shall apply:

  • Cancellation received more than ninety (90) days before departure: full refund less deposit and any non-recoverable third-party costs.
  • Cancellation received between sixty (60) and ninety (90) days before departure: fifty percent (50%) of the total booking value shall be forfeited.
  • Cancellation received between thirty (30) and sixty (60) days before departure: seventy-five percent (75%) of the total booking value shall be forfeited.
  • Cancellation received less than thirty (30) days before departure: one hundred percent (100%) of the total booking value shall be forfeited.

Gorilla and chimpanzee trekking Permits, once purchased from the Uganda Wildlife Authority, are strictly non-refundable and non-transferable under any circumstances. The Company shall not be held liable for any refund of Permit fees regardless of the reason for cancellation.

5. Alteration and Modification of Itineraries

The Company reserves the absolute right to alter, modify, or amend any itinerary, route, accommodation, or activity where such alteration is necessitated by weather conditions, road conditions, government regulations, safety considerations, park closures, or any other circumstance deemed material by the Company. Any such alteration shall be made with the Client's safety and overall experience as the paramount consideration. The Company shall endeavor to provide reasonable notice of any material changes.

6. Travel Documentation and Compliance

The Client is solely and exclusively responsible for ensuring they possess valid passports with no less than six (6) months remaining validity from the date of entry into Uganda, appropriate visas, international vaccination certificates including but not limited to Yellow Fever vaccination, and any other travel documents required by the immigration authorities of the Republic of Uganda or any transit country. The Company shall not be held responsible for any denial of entry, deportation, or travel disruption arising from the Client's failure to comply with immigration requirements.

7. Health, Fitness, and Medical Disclosures

Gorilla trekking and certain safari activities involve strenuous physical exertion at high altitudes and in challenging terrain. The Client warrants that they are in adequate physical and mental health to participate in the booked activities. The Client must disclose any pre-existing medical conditions, dietary requirements, allergies, mobility limitations, or disabilities at the time of booking. Failure to disclose material medical information shall constitute a breach of these Terms, and the Company reserves the right to refuse participation without refund.

8. Insurance

The Company strongly recommends and may require that the Client obtain comprehensive travel insurance covering medical expenses, emergency evacuation, trip cancellation, loss of baggage, personal injury, and death. The Client acknowledges that the Company does not provide insurance coverage and that the Client is solely responsible for procuring adequate insurance for the duration of their travel.

9. Limitation of Liability

To the fullest extent permitted by the laws of the Republic of Uganda, the Company, its directors, officers, employees, agents, and subcontractors shall not be liable for any direct, indirect, consequential, special, or exemplary damages, including but not limited to loss of profit, loss of enjoyment, personal injury, illness, death, property damage, or delay, arising out of or in connection with the provision of Services, whether based in contract, tort, negligence, strict liability, or otherwise.

The Company's total aggregate liability for any claim arising from or related to a Booking shall in no event exceed the total amount paid by the Client for that specific Booking.

10. Force Majeure

The Company shall not be in breach of these Terms nor liable for any failure or delay in performance of its obligations arising from or attributable to a Force Majeure Event. In the event of a Force Majeure Event, the Company shall use reasonable endeavors to provide alternative arrangements, but no refund shall be payable for services not rendered due to circumstances beyond the Company's control.

11. Third-Party Services

The Company may engage independent contractors to provide accommodation, transportation, guiding services, and other components of the Client's itinerary. The Company acts solely as a coordinator and booking agent for such third-party services and shall not be held vicariously liable for any act, omission, negligence, or default of any third-party provider.

12. Intellectual Property

All content displayed on the Company's website, including but not limited to text, photographs, logos, graphics, videos, and trademarks, is the exclusive intellectual property of the Company or its licensors and is protected by copyright, trademark, and other intellectual property laws. No content may be reproduced, distributed, modified, or otherwise used without the prior written consent of the Company.

13. Website Usage

The Company grants the Client a limited, non-exclusive, non-transferable license to access and use the website for personal, non-commercial purposes. The Client agrees not to use the website for any unlawful purpose or in any manner that could damage, disable, or impair the website.

14. Privacy and Data Protection

The Company processes personal data in accordance with its Privacy Policy and the Data Protection and Privacy Act of Uganda. By making a Booking, the Client consents to the collection, processing, and storage of their personal data as described in our Privacy Policy.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Uganda. Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Kampala, Uganda.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with the Booking Confirmation and any other documents expressly incorporated by reference, constitute the entire agreement between the Company and the Client and supersede all prior agreements, understandings, and representations, whether written or oral.

18. Amendments

The Company reserves the right to amend these Terms at any time without prior notice. Amendments shall be effective immediately upon posting to the website. Continued use of the website or Services following any amendment constitutes acceptance of the revised Terms.
